Congress can try to define what is legal, but ultimately is it the courts who decide because obviously the SCOTUS has struck down many laws passed by Congress.
The judiciary goes by the definition of what is legal based on this being a republic.
So they have top jurisdiction.
In comparison, Congress is just going by what it wants to dictate.

They're not allowed to MAKE the law.

They're allowed to tell the President what he can't do.

They're not allowed to tell the President what he MUST do.
