That was never the argument. Having the authority to approve a nominee has nothing to do with whether the nominee is statutorily allowed to hold a position.

Being nominated by the President and subsequently confirmed by the Senate as worthy is exactly what makes someone "statutorily allowed" to hold a cabinet position you pea-brained moron! The duly-elected Senators are the ONLY authority that gets the make the final call here. Not deranged left-wingers who are mad. There is literally no other way with which someone qualifies.

One thing to watch is how the new Fed chair behaves. Inflation is up, and jobs reports are climbing out of the sewer, possibly.

If the Fed lowers rates in its next meeting, we will know definitely that Trump's corruption has infected the Federal Reserve.
The Fed chairman does not possess the power to overrule the majority of governors who will not support a rate cut with inflation on the rise.

Is it possible enough senators will confirm Clayton in violation of the law? Yes. Does his confirmation miraculously bestow on him the necessary job experience to make him legally qualified for the job? No. Are you a nitwit? Yes.
