Look. I really don't see what is so hard to understand. A tariff is a tax, and all taxes have to come from Congress. No damn fatass dumbshit crooked ass president can implement a tax on Americans all by his ******* lonesome. I mean does anyone in their right mind believe a single founder would support this shit?

And I know, I know, it has been done in the past. But unilaterally, it is been rare, it has always required a national emergency. And it has always required level tariffs, and for good damn reason. John Roberts is a player who writes decisions with an eye down the road. His ACA decision was designed to (unsuccessfully) prevent Obama's reelection, and his Tariff decision was to prohibit future (Democrat) Presidents from declaring "national emergencies" to impose whatever draconian measures they dream up.

He understands that Trump can continue his tariffs under other authorities, and I think he will block any recovery efforts resulting from his decision.

Years ago, I read that tariffs could even up the trade situation and return some manufacturing here. It does take a little from projected GDP. Trump has other agendas that make sure the potential of GDP growth is good though. Also, as the world's reserve currency we need a strong nation to keep that which we make out well with and has been dropping precipitously over decades. We saw the supply chain detonate during Covid. We saw shortages of products we needed like infant formula as we had one planet and there was a problem with it that shut it down. Tell us how to get some manufacturing to return with good paying employment.

He cited precedents for fines and penalties, functioning as a tax, while not exactly being taxes. None of those precedents, or the ppaca were rewritten by the Court. The IRS was not able to use it's usual tax enforcement rules on the payment issue.

From the ruling: the district court concluded, Section Three does not apply to the President. The Colorado Supreme Court ruled: Congress does not need to pass implementing legislation for Section Three’s disqualification provision to attach, and Section Three is, in that sense, self-executing.
