No, it would be dismissed. The municipality is entitled to sovereign immunity. In order for the police department to be subject to liability, it would have to be demonstrated that Smollett's injury was the result of an established policy of the police department, known as the Monell doctrine. Not only would this case get dismissed, but federal Rule 11 sanctions would be entered against Smollett and his attorneys for even filing it. I'd like to say that nobody would be stupid enough to file a case like this, but I happen to have been involved as counsel in a few equally ridiculous section 1983 cases. Most of the time they are filed by prisoners. Judges hate them.
