A conviction would require evidence. What the Carrol case was about was “preponderance of evidence”, which nearly the lowest burden of proof required and it doesn’t require any evidence, just that the jury thought he could do it.

I’m really surprised they even allow it because innocent people could be convicted based on zero evidence, all the plaintiff needs is a lawyer to can make the jury think it’s possible the defendant COULD have done it.
