Just two months ago, Bruce E. Reinhart recused himself from Trump's lawsuit against Hillary.
It has been previously disclosed that Judge Reinhart was an Obama donor and also made posts critical of Trump on social media.
If he could not be impartial when overseeing a Trump legal proceeding then, how could he possibly be impartial now for a case involving the former president for which he knew the result was expected to cause serious damage to former President Trump?
It seems that Trump's lawyers might be able to argue that the entire search was unreasonable as a result.
“The undersigned Magistrate Judge, to whom the above-styled cause has been assigned, hereby recuses himself and refers the case to the Clerk of Court for reassignment pursuant to 28 U.S.C. § 455.”
The statute that the judge cited says, in part, that a judge “… shall disqualify himself in any proceeding in which his impartiality might reasonably be questioned …” The statute continues by describing such concerns, including “a personal bias or prejudice concerning a party, or personal knowledge of disputed evidentiary facts.”
