Update at 4:17 p.m.:

The judge has sided with the family of Marlise Muñoz and ordered JPS Hospital to declare her dead and withdraw life support by 5 p.m. Monday.

Update a 4:05 p.m.:

District Judge R.H. Wallace listened to an hour of arguments Friday afternoon, and both sides agree that Marlise Muñoz&#8217;s fetus is not viable and she is dead.

It&#8217;s whether she&#8217;s been &#8220;pronounced&#8221; dead that appears to be the sticking point.

&#8220;I respect JPS&#8217; arguments in trying to follow the law,&#8221; the judge said, &#8220;but every section doesn&#8217;t apply to someone who is dead.&#8221;

There must have been some evidence presented as to the non viability of the fetus. Now the husband is free of both wife and pesky unwanted baby.

He is the luckiest guy since Rust Yates.

If the wife is dead, so is the fetus.

How heartless do you have to be to attack the family in a case such as this? His wife and baby were already LOST. He hasn't suffered enough? He has to be held hostage to your "cause?"

his enormous push to pull the plug without any evidence that SHE would like it is a circumstantial evidence he might have something to do with her having an "accident " to start with
