SCOTUS granted a stay on that. They ruled it was not illegal for ICE to base detentions on such factors as race, language, looks, jobs, etc. Agents can use physical appearance, perceived ethnicity, language spoken, neighborhood, job type as part of reasonable suspicion to stop and question individuals. No difference really than regular law where cops can stop and detain on suspicion of law breaking.

ICE has deport rulings on the people they are after and they are allowed detain anyone for questioning in order to find the adjudicated perps. And no, they don't arrest these people.
