Judge orders ICE to stop most warrantless immigration arrests in D.C.

He was simply at work. Not a justification to even detain someone.
"He" should be thankful an illegal didn't take his job. He should be thankful for ICE. BTW who is 'he?' I didn't see him mentioned in your linked article.

U.S. District Judge Beryl Howell, an Obama appointee, also chided the government for labeling illegal immigrants as “alien criminals.” She said being in the country illegally is not, in and of itself, a crime, but rather a civil violation.
“Consequently, viewing all immigrants potentially subject to removal as criminals is, as a legal matter, plain wrong,” she wrote in an 88-page opinion.
  1. Illegal Entry: Under 8 U.S.C. § 1325, illegal entry is defined as entering or attempting to enter the U.S. without authorization, such as crossing the border at an unauthorized location or using false documents. This act is classified as a federal misdemeanor for first-time offenders, punishable by up to six months in prison and/or a fine. Repeat offenses can lead to more severe penalties, including felony charges.

  2. Unlawful Presence: While illegal entry is a criminal offense, unlawful presence—staying in the U.S. after the expiration of a visa or without legal status—is not classified as a crime. Instead, it is treated as a civil violation, which can result in deportation or removal proceedings but does not carry criminal penalties.

Legal Consequences

Summary

In summary, illegal entry into the U.S. is a crime with specific legal consequences, while unlawful presence is a civil matter that can lead to deportation. Understanding these distinctions is crucial for navigating the complexities of U.S. immigration law

I just quoted something that says it still is (if it is not outdated).
I was being sarcastic. Democrats don't recognize laws. We should arrest the mayors and governors of all 'sanctuary' States and Cities. Since when is it legal to harbor criminals?

It's always been a misdemeanor.
For a first-timer.

If you are a repeate offender, you can potentially charged with a felonly.

Even first timers can do up to six months in jail.

Misdemeanors include criminal offenses. A Misdemeanor is NOT an 'infraction' like a traffic ticket.

Hiring them is a felony but we largely look the other way there.

So, pulled over for being brown, exactly as you said.
U.S. Customs and Border Protection, which is taking part in the immigration enforcement operations in the Keys, said the woman, who has not been identified, refused to hand over her driver’s license, nor roll down her window, when she was pulled over.

“She refused to cooperate and identify herself with all levels of law enforcement there,” said agency spokesman Alan Regalado, noting Monroe County Sheriff’s Office deputies were there

Yes, and you can get locked up for a year on a misdemeanor crime. The problem is, the Judiciary branch is still full of Biden/Obama appointees who refuse to follow the law and are actively interfering with the Executive branch. The only hope is that SCOTUS isn't completely corrupt with those lefty appointees and the woman who doesn't even know she is a woman because when asked what a woman is, she said she didn't know.

*for being brown

15th post
A brown person who would have identified to local LE would have been on their way.
And a less racist less stupid group of people wouldn't have pulled her over in the first place.

She would have been on her way even faster.

Unless there is a valid reason to pull you over you don't have to jump when they say jump.

Noted, they would not say why she was pulled over.

Not sure that is the case.

The could have pulled her over for a burned out license plate bulb (they use that sometimes).

You don't cooperate, you'll be detained.
