Merchan also said something about Trump's insurrection trial in his denial of the immunity motion to delay.

So, this use of "insurrection" is out in public now, and are grounds for dismissal as it is a further taint of the jury pool.

I doubt very much SCOTUS is going to overturn a state stature that's been on the books for ages.
