I understand that the threat to him no longer exists. As a citizen of El Salvador, where were we supposed to send him?

Under 8 USC 1231, the Trump Administration could have identified a 3rd party country willing to accept him. Then gone back to immigration court to have the hold lifted. Once lifted he could have been deported to that country.

Or if the threat no longer existed.

Go back to the Immigration Judge and file a motion to lift their hold and present evidence.

Or they could have gone to the judge and had the withholding order taken off.

They didn’t, which is why the deportation was illegal as SCOTUS has ruled.

That’s not how the system works. But even if it did, he should have the opportunity to challenge that action in federal court.

But he was deprived that chance.

Yes the US sent a Salvadorian national to ElSalvador and didn’t check all the procedural boxes required. I’ve not said they didn’t. That said the US is not responsible for whanEl asap ador does with its citizens. We don’t get to tell them how to run their justice system. If you told me there were 10’s of thousands of people in prison in El Salvador who by our standards have had their rights violated I’d believe you. Is this guy different because he illegally immigrated to the US at some point in his life? Why do you think we have some special jurisdiction over what El Salvador does with regard to this man? At what point is the US no longer responsible for El Salvador violating the rights he would have if he were an American citizen living in the US? If we fly this guy to the US he has a hearing and we put him right back on a plane to El Salvador and he goes right back into be same cell he was in before you’ll be ok with that? What if we Zoom a court hearing?

There is no need to deprive people of human rights and send them to a foreign gulag without due process.

Abrego Garcia's immigration case was in 2019. The administration at the time could have processed him for deportation.
