He's not here legally. That's not denied. What right does he have to stay?

If he were in your home, should the police haul his ass out of your house or do you have to take him to court and begin the eviction process?
 
I will note that the extradition treaty is not the best vehicle for this.

Garcia has not committed any crimes for which the treaty requires. But this is a miscarriage of justice if he's innocent and being held without cause.
He was returned to his home country. El Salvador’s president says he will not force Garcia to return to the USA. It will be interesting to see if he comes back voluntarily knowing he faces prosecution for illegal entry and jail time.

Under what proceeding? Title 8? The Alien Enemies Act? The 2019 order specifically said he not be sent there. He could have been deported to Guantanamo, but no.

Was he given proper notice of his removal? No. What the Judge who issued the 2019 order obeyed? No. The order was disobeyed. Violated.

I'm not going to sit here and disregard due process for someone simply because I don't like who they are. He is explicitly covered under the 5th and 14th Amendment.

Why would we stop that? We are sending literally murderers and rapists out of our country, to someone willing to take them and makes sure they do not come back. At $20K per scumbag, that's a bargain.
