The last legally constituted government in Palestine was the unity government of March 2007. There is no term limit. That government serves until legally replaced.
both Arafat and Abbas have call for emergency governments. How is the PA to function, you want them all to just go home an let the PA fall to pieces? This is what happens. Fayyad was appointed and served at the pleasure of Abbas till his resignation was accepted. The government must still function and cabinet or not Fayyad served as PM for five years. That is how he is listed by the PA government sites. That is what he was.
Are you going to take the matter to palestinian court? How is that going to serve the people? PA is not the US, things don't work the same. What of the war and emergency powers act? You think the US has not found a way to function under a state of national emergency?

Not at all. Their constitution was written to prevent a power vacuum.
If they lose the president the speaker of the PLC temporarily assumes the office of the president and calls for an election within 60 days.
The government (the prime minister and his cabinet) cannot be removed it can only be replaced. The constitution lays out the procedure to do that. Abbas never followed that procedure. Abbas swore in the new government without the PLC approval that the constitution requires.
There can't be an election unless Hamas allows PLO parties to run in Gaza or even allow the balloting to be carried out. Hamas and Fatah are still arresting and killing each other in both the WB and gz. They can't just call an election and expect it to happen out of thin air especially if Hamas won't let Fatah or other PLO member move free within gz, or even enter.
Why do you think a unity government is so important to be formed first? Did you forget that Hamas too gz by force and kick, or killed, Fatah out? What did you think was going on between them all these years?
