Trump loses bid to delay sentencing in hush money case as he appeals

NEW YORK, Jan 6 (Reuters) - U.S. President-elect Donald Trump on Monday lost a bid to put off his sentencing on Friday for his criminal conviction stemming from hush money paid to a porn star.​
Citing both presidential immunity and the demands of Trump's impending Jan. 20 inauguration, his lawyers on Monday morning said Justice Juan Merchan's intention not to penalize Trump was "of no moment."​
"Presidential immunity violations cannot be ignored in favor of a rushed pre-inauguration sentencing," the lawyers wrote in a court filing.​

That's it. Trump gets his due. He broke laws. He got investigate, indicted, charged, tried, and convicted. Donald J Trump is the first and only US President (former and soon to be sitting) to carry the dishonor of a felony conviction.

That makes the US President a convicted criminal.

Why it matters: Judge Juan Merchan has already indicated Trump will not face jail time when he is sentenced just 10 days before his inauguration. But the president-elect's legal team is still trying to walk back his historic conviction.​

Driving the news: The court found that Trump's points are, for the most part "a repetition of the arguments he has raised numerous times in the past," Merchan wrote in a Monday filing.​

A New York appellate court on Tuesday declined to halt President-elect Donald J. Trump’s criminal sentencing, setting back his hopes of shutting down the case before returning to the White House.

Mr. Trump, who is scheduled to face sentencing on Friday, 10 days before being sworn in for a second presidential term, had asked the appeals court to intervene and freeze the proceeding. His lawyers argued that Mr. Trump was entitled to full immunity from prosecution, and even sentencing, now that he was the president-elect.

The emergency application fell to a single appellate court judge, Ellen Gesmer, who held a brief hearing on Tuesday before denying Mr. Trump’s request 30 minutes later.

At the hearing, Justice Gesmer appeared highly skeptical of Mr. Trump’s arguments, grilling Mr. Trump’s lawyer about whether he had “any support for a notion that presidential immunity extends to president-elects?”

Who is Juan Merchan, the 'no-nonsense' judge who oversaw Trump's hush-money case?​

Donald Trump has described the judge who oversaw his hush-money trial - where he was found guilty on all 34 felony counts of falsifying business records - as a "certified Trump hater".
Others say New York County Supreme Court Justice Juan Manuel Merchan is a tough and no-nonsense but fair jurist.
Before this case, the most high-profile to ever cross his courtroom, Justice Merchan served 17 years on the bench.
He is also no stranger to the drama Trump brings to the justice system.
Legally speaking, the jurist and newly-convicted felon have crossed paths before.

In 2022, Justice Merchan presided over the tax-fraud trial that led to the conviction of the Trump Organization's chief financial officer, Allen Weisselberg.
He is also the judge for the fraud and money-laundering case against Steve Bannon, a staunch Trump ally. That trial begins in September.

He worked as a prosecutor, first in the New York County District Attorney's Office, then as an assistant attorney general in both Nassau and Suffolk counties.

He was appointed a family court judge in 2006. But since 2009, he has presided over criminal matters at the New York County Supreme Court.

"He's a serious jurist, smart and even-tempered," Manhattan defence attorney Ron Kuby told NBC News.
"He's not one of those judges who yells at lawyers, and is characterised as a no-nonsense judge. But he's always in control of the courtroom."

In the case against the Trump Organization, Justice Merchan was adamant that the charges were absolutely not politically motivated.

The organisation's lawyer had argued Weisselberg was being targeted because of his association with the former president.

"I will not allow you in any way to bring up a selective prosecution claim, or claim this is some sort of novel prosecution," Justice Merchan said, according to the BBC's news partner CBS.
