The guard has to follow the law, whenever activated. Guardsmen have been prosecuted after state duty, during emergency relief operations, for offenses while on duty, as well as during off duty periods. Be it state orders or Title X, Federal activation, they are still stuck, having to act within the laws of whatever state they are in. The difference between the two types as far as the law goes, is that under state duty, they are usually under state laws, not the Uniform Code of Military Justice, as well as state laws, that are in effect. Once, under the Federal side, they are in fact, active Duty Army, more often than not, under the control of an active duty Commanding General, unlike a state activation, in which control authority goes up through whatever command in charge of operation to the state adjutant General, who is under orders of the Governor of the state.
 

And those prosecutions will be under state law where Trump's pardon infamy does not work. And if you think a "just following orders" defense will save you, you should study up on the Nuremberg trials of the Nazis after World War II.

Whatever would make you think Trump or whatever Regular Army General in charge of a title 10 Federally commanded Army operation, would order them to do illegal acts? Is it wishful thinking for just foolishness? Active duty Officers and Enlisted have been courts martialed while on Active duty, even in war zones for illegal acts. Prison time is prison time. National Guard Officers on active duty, are in fact, Army, as it says, right on their uniform, having the same rights, duties and penalties of any other Army Officer, and taking the same Oath, to support and defend the Constitution of the United States against all enemies, foreign and domestic, and to faithfully discharge the duties of the office. Notice, it says nothing about following any supposed illegal orders of a President, in fact it does not mention the President, at all. The legality of their actions, they face on their own, Military, Federal, civil, or state laws. True, if on duty, they can have a JAG Officer Represent them, but if blatantly illegal, it will make no difference, other than saving them attorneys fees, on their way to prison, if the offense calls for it, and it is doubtful an Army JAG Officer has a good understanding and experience in state courts.

Yes, we are curently in an authoritarian state.

We have armed, masked government agents occupying US cities, whose budget just tripled while the rest of law enforcement had their budgets cut. This agency explicitly advertises white supremacy and loyalty to Trump as their guiding ideology. They’re rounding up people in vans, dissappearing them, violating their rights to due process, ignoring court orders, and building massive concentration camps. They are purging the government of those who are not loyal to the Trump’s lies and eviscerating any independent authority. They are weaponizing the government against perceived enemies. Congressional statutes are willfully violated. The President is extorting media companies and forcing them to fire people who criticize him. They are openly rigging the midterms. He is openly corrupt is ways we have never seen personally benefiting from his office and using agencies to maximize his interests.

He doesnt have that “right.” But he is right that he is now a dictator. He has never faced any consequences for his lawlessness last time and is going all in this time.

I think any judge stupid enough to try a Guardsman will find his court room full of armed Guardsmen in civilian clothes daring him to convict their brother or sister.

The national guard being used without the permission of a governor is a violation of the law.
Tell that to the governors of Arkansas, Mississippi and Alabama back in the sixties when they tried to use the Guard to enforce segregation.

The military won’t allow them to be prosecuted. If in danger of political prosecution, a courts martial will try them, find them innocent and double jeopardy will prevent any civilian court from trying them. I’ve seen it done when local Law Enforcement developed a pattern of prosecuting soldiers for off- duty actions.
