What's to stop him is congress. Of course he can always declare a national emergency.... In order for the president to use a declaration of a national emergency to accomplish his political goals and fill campaign promises, he needs enough support from congress. Trump has it now. If he decides to bypass congress to fulfill his campaign promise to build a wall under the guise of a national emergency, he may lose it.
