If that's all that happened, which almost certainly is the case, then there's nothing there to arrest him on. That's freedom of speech 101. Furthermore, he's innocent until proven guilty, which would mean that further evidence would need to be provided against him.

For sure a person standing by in a riot and calling cops 'bitches' though is just as guilty--aiding and abetting--as those doing the actual damage.
