For there to be an acquittal it isn’t just a dismissal. The defendant has to be found not guilty. That would be a bench verdict. And pretty much all of her statements and decisions were overturned. As the Special Master was.

On that one point, yes. Charges she dismissed could be appealed and refiled. Even if she tried to dismiss with prejudice that finding too could be appealed.

But on every other point I raised, no. Its highly unlikely.

Appeals courts rarely inject themselves into an active trial. Instead, they review the verdict and the rulings after.

And if Trump is acquitted because she's thrown out key evidence, given bad instructions to the jury, or once again radically reordered caselaw, there is no appeal.

Trump announced he was running for President. To negate the DOJ’s political possibilities. A Special Prosecutor was demanded. They got it.

Now they’re furious that the Special Prosecutor was able to get an indictment. The Prosecutor they demanded to get the investigation out of the hands of the political DOJ.

They demanded to know the charges. Daring the Prosecutor to release the indictment. They got that.
