As a US citizen it certainly does. ICE can detain you, but they have the burden to prove you are not a citizen and deport you. That includes a hearing.

Being present in the U.S. without legal documentation is a civil violation, not a criminal offense according to the American Immigration Council. While it's not a crime to simply be in the country without authorization, entering or reentering the U.S. without permission is a federal misdemeanor.

While there is no penalty for being present in the US without documentation you will probably be charge with Unlawful Presence, a civil offense with the primary consequence being deportation.

Probably the major difference in immigration enforcement under Trump versus previous presidents is that the Trump administration does not consider extenuating circumstances such as unable to locate documentation, meeting the legal requirements to stay in the country, your kid is in the hospital dying of cancer, etc...

Of course if you have a 5 million dollar Trump card or a genuine Trump red hat, that's all the documentation you will need.

Unfortunately the birth certificate is the basis of most acceptable documents. However, she can go the route of discovering family bible records, hospital records, testimony by friends and relatives to present in court to get an order to create a birth certificate. Since she doesn't know her exact birthdate and a birthplace only somewhere in a 2 state area, the cost and time to investigate would be well beyond her meager earnings as a housekeeper.

It can be quite difficult if you were abandon by your parents which is not uncommon with migrants. Migrant families often take in children that are not their own.



As I said, if you were abandon by your parents which really does happen among migrants, particular when there is only one parent, another family may takes the child. A temporary arrangement becomes permanent. For migrant workers, moving from farm to farm and state to state, birthdates and birthplaces of kids are often lost in the shuffle. Although not so common today, 20 or 30 years ago births in migrant housing was not uncommon. That is where my housekeeper said she was born.

If you were born in another land, having a birth certificate may not be helpful.

If you were born in the USA and don’t have a birth certificate, they aren’t exactly difficult to obtain.

If you can’t get it, maybe, in fact, you aren’t a U.S. citizen.

You can go to the actual place where you were born, or the place your family lived when you were born if different.
