If there are multiple punishments that can result in conviction, that one of them is moot, doesn't make the entire case moot.

Bizarre like that it gets!

Had the insurrection succeed and either the EC vote stopped, or invalidated, then the 12th amendment would apply, and the election thrown into congress, with the bulk of states (in the house) and the bulk of senators, voting for Trump/Pence.

They would declare that since Trump was legally elected, that he shouldn't be impeached / convicted for the insurrection that made his legal election possible.
