Here's the problem most of you anti-abortion types have. Outlawing abortion is a practical impossibility, especially with most of them being performed by pill now.

Before Roe (which was a bad decision), abortion laws were like the prostitution laws. They were on the books, but they were rarely enforced and frequenlty broken.

Both the death of the woman and the death of the fetus are offenses against the would be mother , for which penalties can be commensurate with the crime .

The legal hubris is that the fetus has constitutional protections , however a death penalty cannot be applied to killing of a fetus because to have a rite to life removed , one must remove the rite to life of another , and since a fetus does not have constitutional protections the death penalty is explicitly excluded .

States do not have the power to abrogate us 14th amendment , which includes an enumerated rite for equal protection with a citizen , where equal protection requires a live birth as the only non incidental requirement to become a citizen , while us 9th amendment relates that not all rites must be enumerated - though traitors against us republic forsake it .

The term person ( per son - countable by census ) in title 1 section 8 of us code reiterates the live birth requirement for equal protection as it is defined as any born alive .


The basis of roe v wade ( wise decision ) is a live birth requirement for equal protection with a citizen , thus the dumbfounded decision of dobbs by scotus is sedition against us 14th , 9th , 1st and 10th amendments and malfeasance against title 1 section 8 of us code and they should be charged with the crimes .
