Homan took $50K bribe from undercover agents

From an above post:


a) the FBI apparently tried to set up Tom Homan for a FUTURE crime, knowing the alleged payment (even if it happened) could not be illegal, since Homan was not on the public payroll and

b) this failed operation was leaked, despite the fact that no laws were broken, for obvious political reasons.

Assume Homan took the money, but had nothing to give in return so no "bribery" as defined by the statute.

As two private citizens, what was the money for? A gift?

No -- what I expect Homan to say is the same thing lobbyists say:

You paid me to answer the phone when you call and have a problem.

Beyond that is for a later discussion depending on the facts.

Some people are willing to pay for that -- others are not.

It is -- for lack of a better description -- a "concierge-like" service.

Its like a payment for "The Wolf" to standby and answer the call.

That's what could be said.

Questions related to the Homan cash bag story. Do you get to keep the money from a sting operation if they never charge you?

If Homan did keep it (Leavitt says he didn't), do you think he declared $50k on his taxes? Section 61 says income is income from whatever source derived.

I’d bet he kept it and I’d bet he didn’t report it
