It is not reported that way. Legality is not determined at the border. Those that cross the border without proper documentation are reported as encounters.
The number of encounters peaked Dec 2023 at 248,741 and have plummeted to 58,038 in May 2024. Don't have the latest figures but they will be nearly half of that now.

The Customs and Border Protection Agents and the Immigration Agents are going to follow procedure and the law. They're certainly not going to deny cases because they are flooded with applicants. If the applicant answers the questions correctly and is consistent and the background investigation supports the claim then the agents has to past the applicant on to the next phase, immigration court.
That's the media talking point clean up line to take the heat off her. But the fact is she was put in charge of working to stop the invasion and she didn't even try to do the job she agreed to do.

However a Customs and Protection Agent in a preliminary interview at the border will ask the applicant questions to determine if their claim meets the requirements of law. The agent is not equipped to investigate the claim, determine the truth, nor examine evidence. If there was a Border Czar it was Alejandro Nicolas Mayorkas, Director of Homeloand Security. He was responsible border security and House thought was doing rotten job. So they investigated him and tried impeach him. Nowhere in there "in depth" investigation, was Harris ever mention. It was not until she became heir apparent to the nomination that republicans settled her

Liz Cheney has turned her back on the Republican Party but she remains a strong conservative. She believes the party has abandoned it's conservative foundation in favor of Trumpism. If Trump loses this election at his age, he will be yesterdays political news. I think she and a number of other solid conservatives are waiting to see what happens when Trump is out of the picture. Will the Trumpeters find a new demigod to support or will they put their faith in the party and it's conservative foundation. However, don't expect this to last. Emergency actions taking by the Biden administration to limit asylum applications and requiring a scheduled asylum interview before crossing the boarder clearly violates the asylum law. With slowing of the flood, the courts will act soon to overturn Biden's executive orders. This year Mexico has finally given in to US pressure and cracked down on migration through their southern boarder. This too will not last. The government's action is not popular in Mexico and will end by the end of this year.
To summarize we can not solve the problem with emergency presidential actions. We have to either greatly increase the number of immigration courts so asylum applications can be processed in weeks not years and/or we're going to have to change the asylum law to put on some limits.
