The purpose of CBP1 app is to reduce the number of people applying for asylum by restricting the number interviews to match the number of personnel assigned to conducting those interviews. It is clearly illegal but the courts are letting Biden's EO stand at least until it has been challenged in court which will probably be very soon.

Since we do not have sufficient detention facilities for over two million people, most of them have been released with various degrees of monitoring, living in detention centers, shelters, rundown hotels, with relatives, and on the streets.. Each person is require to carry a temporary resident permit. This permit does not give the asylum seekers the right to work. They can apply for a temporary work permits 180 days after applying for asylum. Trump tried to change the wait period for a work period to a year but failed.

The wait for court can be anywhere from 3 to 7 years depending on the number of hearings that are necessary. Each asylum applicant carries a phone number they can call for help at anytime. That number is the US immigration service that will provide food and housing, if the applicant withdraws the application for asylum and agrees to a voluntary deportation.

It is amazing what some people will go through for just a 30% chance of being able to make their home in the US, a prize few Americans appreciate.

And Biden issued a number of orders that dealt with immigration but none had huge effect of involuting Title 42. Once the CDC declared a healthcare emergency, Trump issued an EO evoking Tittle 42 which effectively stopped legal border crossing, asylum claims and a number of other activities. This lasted through the Trump Admistraion. Biden reissued the order when he took office. When the CDC ended the healthcare emergency, that also ended the executive order. This resulted in a sharp increase in border encounters which peaked in Dec 2023 at 249,000 encounters. In August 2024, encounters had fallen by 77% from the peak and are expect to continue falling throughout this year.

Executive order are in effect work orders to the executive branch personnel typically reflecting presidential policy, interpretation of legislation, etc. A new president brings on new policies and thus will issue his own EOs.
