No. Over half of the migrants we have seen crossing our southern border over the last 3 years are claiming asylum. And most of those that do not claim asylum immediately and are detained will do so before being deported. Crossing an international border to claim asylum is not illegal and the asylum seeker's case must be heard, according to both U.S. and international law.
Here is the problem. Up to about 2020, asylum seekers were few in numbers compare to others crossing our border. So border officials could easily handle asylum cases in 90 days as required by law and immigration regulations.
Several things happen in Central and South America. Gang violence grew exponential, unemployment rose signicantly, and human rights groups educated people about asylum in the US and other countries. As a result In 2023, we had nearly 800,000 unprocessed applications for asylum that have not been heard or fully investigated and the number continues to rise. There are now over 2 million people who are waiting to see if their asylum application will be accepted and they are all legally in US. With the number of asylum immigration officials and judges, it takes about 3 years for a case to be heard. By law we can not turn them away until they have their day in court and we have no place to put them.
Biden's emergency executive order limiting the number of asylum seeker applications per month and Mexico's willingness to slow the migration across their southern border will not last. Mexico is under a lot of political pressure to allow more migrants in and the US federal court have made it clear that the court considers Biden's elective order only a temporary measure.
The only solution is legislation.

Word got out that making a fake claim got you into the interior and Biden and Harris weren't even going to pretend to try to slow the flood.
By law we can not turn them away until they have their day in court and we have no place to put them.
I agree, we need to deny their fake claims at the border, not at some future court date, years in the future, that many will simply not even appear for.

There is a lot we can do about it by changing immigration law to:
1. Document in law that the president has the authority to limit the number of asylum application per month when the number exceeds the capability of immigration agents and courts to process applications in 90 days.
2. Increase the number of immigration judges and immigration agents needed to process applicants.
3. Increase the number of personnel at the border needed to handle detainees.
4. Provide addition housing at the boarder for detainees so they do not have to be released into the communities.
5. Limit the time a migrant has to file an application for asylum.
6. Take steps necessary to encourage migrants to file applications for asylum at consultants and embassies and not at the US border.

Of course, we have always had people waiting for asylum but not a backlog of 2 million. We do not have enough immigration agents to process them or immigration judges to hear the cases and we certainly don't have enough secure monitored housing for them.

By law, there claims have to be investigated and they have the right of a hearing before an immigration judge and all rights of due process apply. By law, if the court rules against them, they have the right to appeal. And they can not be deported until their case is settled. In short, no matter who is president, the courts will see that the law is followed.

Those that do not ask for asylum at the border and are detained, almost always ask for asylum later. Once detained, a migrant has up to a year to request asylum. Thus just about everyone asks for asylum today.
However, everyone that asks for asylum does get not get a court date. There are two interviews the applicant must pass to determine if by law he has a case for asylum. The first interview is by a trained customs official at the border. The applicant is ask about a dozen question. If the applicant does not give the proper answers, he will be deported rapidly unless he asked for second interview. If he does, another agent ask similar questions. If he passes, he will be detained for detailed investigation and further questioning otherwise he will be deported.
If the immigration agent after interviews and investigation believes the applicant is telling the truth and has a a case, then the applicant is assigned a court date which is currently about 3 years out. Thus a process that is required by law to be completed in 90 days can take 3 yrs or more, simply because there are far too many applicants for system to handle. The interviews and investigation process eliminates about half the applicants.
While waiting for a court date, the applicant has legal status and can not be deported.

It is not reported that way. Legality is not determined at the border. Those that cross the border without proper documentation are reported as encounters.
The number of encounters peaked Dec 2023 at 248,741 and have plummeted to 58,038 in May 2024. Don't have the latest figures but they will be nearly half of that now.

The Customs and Border Protection Agents and the Immigration Agents are going to follow procedure and the law. They're certainly not going to deny cases because they are flooded with applicants. If the applicant answers the questions correctly and is consistent and the background investigation supports the claim then the agents has to past the applicant on to the next phase, immigration court.
