BLUF: Terrorism is a state of mind. Contrary to popular belief, not all terrorism is bad. Political terrorism, as an example of this, is COUNCIL DECISION (CFSP) 2019/25 8 JAN '19: wherein the EU Council made the decisions with regard to ‘HAMAS’, including ‘Hamas-Izz al-Din al-Qassem’ have been involved in terrorist acts within the meaning of Article 1(2) and (3) of Common Position 2001/931/CFSP.

It is NOT just the US that designates HAMAS but all of Europe. Terrorist Acts are defined in context, it may seriously damage a country or an international organization. They are (in context) "criminal acts" directed against Israel, intended or calculated to create "terror" in the minds of the citizenry and general public, or in the broader sense: endangering national security, public order, public health or morals, or the rights and freedoms of others.

It is about the "act" in connection with a perpetrator.
