Georgia teen De'Marquise Elkins sentenced to life in prison for fatally shooting infant in its stroller* - NY Daily News

I am, of course, still wondering why both the father and mother had gunpowder residue on their hands, and why Sherry's daughter thinks that her mother killed the baby (just like the other one).

Antonio Santiago Update: Gunshot residue found on slain Ga. baby's parents, report says - Crimesider - CBS News

(CBS) BRUNSWICK, Ga. - The father and mother of Antonio Santiago, the 13-month-old baby who was allegedly fatally shot in Brunswick, Ga. by two teens in March, had gunshot residue on them the day their son was killed, according to the state's forensic report obtained by CBS affiliate WTEV.

While the fact that Sherry West, the baby's mother, was also shot during her son's killing could explain why residue was found on her, it is unclear how or why the baby's father, Louis Santiago, would have been exposed to gunshot residue.

A conclusion from the state forensic report says, "This supports the possibility that [Louis Santiago] discharged a firearm, was in close proximity to a firearm upon discharge, or came into contact with an item whose surface bears GSR [gunshot residue]."

But let's just ignore all that, and go ahead with the prosecution.

The making of a racist travesty | SocialistWorker.org

THE STATE of Georgia seems to be in the process of adding another travesty of justice to the long list of them inflicted on African Americans.

Two Black teenagers have been imprisoned without bail for more than four months on charges that they shot and killed an infant at point-blank range after her mother told them she had to money. But there are no witnesses other than the mother, no physical evidence tying the two accused to the crime, and no real explanation for why the young men would commit such a cold-blooded crime.

The only "evidence" against them is the claims of the white mother, which have holes and inconsistencies--and an ugly campaign by authorities and the media to portray one of the accused, along was his whole family, as a bunch of criminals and thugs.

From the behavior of cops and prosecutors to the media circus that has surrounded the case, the so-called "Baby Santiago" murder bears all the hallmarks of racist frame-ups of the past. In the wake of the acquittal of George Zimmerman for killing Trayvon Martin, this case shows another face of the criminal injustice system--and how it is saturated with racism, through and through.

The fact that the prosecution didn't even bother following up on the gunshot residue is actually a good thing as far as appeals go.

De'Marquis Elkins Arrested: Teens Allegedly Kill Baby, Antonio, In Front Of Mother, Georgia Police Say

In the begining:

BRUNSWICK, Ga. — The mother of a baby shot dead in his stroller took one look at a teenage suspect's jailhouse mugshot Saturday and said he was definitely the killer. Yet an aunt of the teen said he was eating breakfast with her when the slaying took place.

Katrina Freeman said Saturday the shooter can't be her nephew, Elkins, because he showed up at her house Thursday at 8:15 a.m. – roughly an hour before the killing. She said she cooked eggs, grits and sausage for breakfast and that Elkins accompanied her and her children to run errands when they left at about 11:30 a.m.

"He was with us the whole time," said Freeman, adding that she gave police the same account of her nephew's whereabouts. "There is no doubt in my mind that he is innocent."

BRUNSWICK - A handgun discovered Tuesday will be tested to determine if it was used to kill a Brunswick baby last week in a stroller.

After police arrested the mother and aunt of murder suspect De’Marquise Elkins, 17, Tuesday morning on charges of making false statements, the women provided information that eventually led investigators to the gun, Glynn County Police Chief Matt Doering said.

Investigators found the gun about 8 a.m. in a marsh pond east of U.S. 17 near its intersection with Spur 25, Doering said. That was about three hours after the arrests of Elkins’ mother, Karimah Aisha Elkins, 36, and aunt, Katrina Latrelle Elkins, 33.

As for the Father of the slain baby:

BRUNSWICK, Ga. -- Louis Santiago is now locked up in the Glynn County Detention Center along with the teen charged with murdering his 13-month-old son, Antonio.

The child's mother claims Santiago "went nuts" in the months following the baby's death and he violated a restraining order.

But if the baby's father was not at the murder scene, what could explain gunpowder on his hands?

West told Action News that she has an answer, "He may have touched my clothes in the hospital if there was GSR."

A conclusion from the state forensic report says, "This supports the possibility that (Santiago) discharged a firearm, was in close proximity to a firearm upon discharge, or came into contact with an item whose surface bears GSR."

That's all I got...

It seems as if the jury doesn't understand the concept of 'reasonable doubt.'

Based on the extracts from news articles, it seems like in the South, black people are still treated like shit. I've never heard of relatives of a suspect being arrested with such alacrity for making statements that the police suspect being false in regards to the alibi of the suspect. Unbelievable.

I don't understand why people continue to live in such places as 'tornado alley' or why blacks continue to live in the South.

I was not familiar with the story, but in reading this article, I can see some reasonable doubt: http://www.huffingtonpost.com/2013/08/28/baby-stroller-shot_n_3828542.html

Why would they just shoot her in the leg and kill the baby? Reminds me of the Diane Downs story where she shot herself in the arm, then fatally shot one of her kids and tried to kill the other two.

Glassey, 21, lives in New Jersey and testified through tears that she had only seen her mother for a few hours on one occasion since she was 8 years old.

It appears that the daughter doesn't know the mother well enough to form an opinion on why "The whole conversation just didn't settle well with me,".

Really? Cuz I've never met the woman, and if she asked me how soon I think she'll get the life insurance money, my eyebrows would be buried in my hairline.

Dominique Lang, 15, testified at the trial he was with Elkins when the older teen pulled a gun and demanded West's purse. When she refused to give it to him, Lang said, Elkins twice threatened her baby and counted down from five.

Yes I read that, but it's the type of testimony I, as a juror, would take with a grain of salt. Lang has all kind of motivation to testify against Elkins, to lie about it. Duh.

"Glassey's grandmother had died the summer before and she had collected her grandmother's life insurance policy to cover expenses, Glassey said. Her mother knew that and called to ask how fast Glassey thought it would take for her to get the payment from a life insurance policy she had taken out on the baby."

She needs money to bury her baby would be my best guess.

Based on this article also, there seems to be some room for reasonable doubt.
De'Marquise Elkins Accused Of Killing 13-month-old Antonio Santiago Hid Gun: Witness

Another thought: If he is truly guilty, whatever happened to the idea of rehabilitation? He was only 17 at the time of the killing, and he gets life in prison. Will there be an opportunity for parole? Is rehabilitation even considered anymore?

Who's to say?

For sure the baby will never grow up to be 17.

Police recovered a .22-caliber revolver from a saltwater pond, and prosecutors said it matched the gun used in the killing. Prosecutors also have said information from Elkins' mother and sister led them to the weapon.

The firearms expert who testified said the gun 'could' have been the one used in the crime. He gave no definitive testimony that it matched or was the gun used in the crime. He also testified that the bullets used 'could have' been fired from the gun they found, but he was not able to say so definitively. Read the link I posted. The gun the suspect's relatives led to isn't necessarily the one used in the shooting.

How did the mom and sister both know there was a gun in the pond?

This is too funny. My God, you people would have acquitted OJ and convicted Zimmerman!

Scary how adults (I am presuming here) can be so stupid.

I think what you need to do is watch the movie 12 Angry Men. In all that I read about this case, the gun is the only piece of evidence that seems strong, yet there is doubt about it being the gun used in the crime.

Based on the evidence, I would have convicted both Zimmerman and OJ.

Based on the evidence here, I'm not sure.
