Trump, nor Pence or Biden where charged with having documents. Only Trump was charged under the Espionage Act (18 USC 793e) for failure to return the document when directed because - wait for it - they voluntarily returned the documents when found.

Yes, his lawyers were closing out his U. Penn office and found the documents. They contacted the National Archivist for transfer which led to expanded searches including voluntary searches of his home by the FBI. The expanded searches located some more documents in his home.

During the whole thing Pence and Biden cooperated with authorities to locate and return the classified documents.

Which is not what Trump did, he refused to return documents and activiely obstructed justice be attempting to evade a federal subpeona.

That's why Pence and Biden werer not charged and Trump was charged. None were charged with "having" the documents, Trump was charged with refusing to return them.

The Judge delayed, delayed, delayed. Even issuing at least two orders that had to be appealed on an interlocutory basis in that very case. Both time she got overturned and slammed by the appeals court. The appeals court was not happy with her performance and her dismissal would have been overturned and the case returned for trial.

However Trump achieved his goal for running for reelection not to be President, but to stay out of prison. With his election the prosecution was forced to drop the case while Trump was in office.

A decision that ran out the clock until after the election but would have been reversed on appeal.

The case was dismissed by a radical Judge and that dismissal would have been overturned on appeal. But she allowed him to run out the clock.

The charges were fully merited and he knew if it went to trial that he would have been convicted of espionage and obstruction. Scared the living hell out of him.
