As long as anti-federalism and state jurisdiction under us 10th amendment are based upon free association elements of individual liberty , then we can be in agreement , however us 10th amendment is often invoked to demand state rights to determine whether abortion is legal or illegal .

That a state is comprised of and for citizens , where birth is required for citizenship and consequently for an instantiation of protected wrights , us 9th amendment and not us 10th amendment applies to abortion wrights .
