A panel of federal judges has blocked Texas’ newly-redrawn congressional map — which made five districts in the state more favorable to Republicans — saying the plan appeared to be an illegal race-based gerrymander.


In a 2-1 ruling, the court ordered Texas to rely instead on the boundaries legislators drew in 2021. The new map, the majority concluded, appears likely to be unconstitutional and was drawn at the urging of the Trump administration.

The map ultimately passed by the Legislature and signed by the Governor — the 2025 Map — achieved all but one of the racial objectives that DOJ demanded,” U.S. District Judge Jeffrey Brown, a Galveston-based Trump appointee, wrote for the panel majority.

NOt surprising at all. 47 will appeal. Texas wanted lily white Congressional Districts and got them.

This will all be moot when the SC decides that gerrymandering based on race is unconstitutional.

Did you mean to say that SCOTUS will decide that race based gerrymandering is constitutional? Or to say that the Civil Rights Act prohibitions on race based gerrymandering are unconstitutional?

That all gerrymandering will now be equal, based on politics as it should be.
 

Federal court blocks Texas from using new congressional map for 2026 elections​

WashingtonA federal court on Tuesday blocked Texas from using its newly redrawn congressional map in the upcoming 2026 midterm elections.

In a decision authored by U.S. District Judge Jeffrey Brown, the court ordered the state to instead use House district lines adopted by the Texas legislature in 2021 for next year's congressional elections. The dispute was heard by a three-judge panel, which divided 2-1 in finding that voting rights groups that challenged the map were likely to prove that the 2025 map is an unconstitutional racial gerrymander.


It ain't over 'til it's over with the SC in Don's back pocket. The thing is, the court's conservatives may have put themselves in a box by ruling a few years ago that matters of redistricting are not within their purview.

The panel of three federal judges in El Paso, in a 2-to-1 decision, sided with civil rights groups that had sued to invalidate the map, which was part of Texas’s aggressive mid-decade push to draw new congressional boundaries at Mr. Trump’s behest.

“The Court orders that the 2026 congressional election in Texas shall proceed under the map that the Texas Legislature enacted in 2021,” the court said, issuing a preliminary injunction barring the use of the map drawn this summer.

In a 160-page opinion, the court found that “substantial evidence shows that Texas racially gerrymandered the 2025 Map.” The court cited a July letter from the Justice Department to Texas lawmakers, focused on the racial makeup of districts, in which federal prosecutors said the state’s existing map was unconstitutional because it included districts where no ethnic group had an outright majority. The court said that was a “legally incorrect assertion.”


Of course, if the case ends up being decided by the TX SC it will ignore the evidence of racial gerrymandering and find for the R's.
