He doesn't know and doesn't need to know. Because he doesn't know the status of every single person that he comes into contact with in public, every person he walks by on the street. But he doesn't NEED to know. But what we DO know is the cop is armed to the teeth. If the guy is filming him, then that's all he is. I'm not saying he can stand on the cops toes to film him, but less than 25 feet? Um, yea. I do think so.

Again, if cops are SO SCARED that someone standing 10 feet away with a cell phone recording them scares them, then they shouldn't be a cop.

This is a person with interest in what the officer is doing, approaching the officer to interact with what he is doing.

Most of our rights were designed to protect the people from the government.

It's always been illegal to interfere with a police officer doing his job and overturning this law wouldn't stop that. It was a feel good law, nothing more, "look what we did".

Sadly there are far too many people willing to allow the police to violate people's rights because they live in fear daily. Some of it has to do with outright racism.
