NO Hur did not find that Biden was too old to face charges, he found that jury would not find him guilty beyond reasonable doubt, because they would give him the benefit of...wait for it...DOUBT. Why? Because the evidence of the state of mind was lacking.

The special counsel said he committed crimes "willfully". His dementia was the factor that prevented them from recommending criminal charges. There's no reason for the special counsel to ever list "elderly man with a poor memory" as a rationale for not pursuing charges if there isn't the evidence to do so. Duh! Think! If there is evidence for crimnes so but dementia would impede the ability to obtain a conviction then, yes, that's when it's relevant to state.

Facts:

1. Biden willfully retained classified material. That's a criminal act.

2. Hur declined to recommend charges for this willful criminal act because Biden had dementia.
