Expelled Oklahoma U fraternity to sue university, possibly President Boren

Since the university no doubt has codes of conduct and a bunch of legalese that probably none of these drunk frat boys bothered to read before they signed, not so much.

Oh, look everyone, Mac is coming out in favor of racist frat boys.

Oh look, JoeB131 is coming out in favor of Racist Black rapper boys

Here's an update at KFOR one hour ago.

After the press conference, the national spokesperson of Sigma Alpha Epsilon, Brandon Weghorst, released a statement.

The national organization is not involved in retaining Mr. Jones and, as of now, we have no further information about his intentions.

Our priority now remains squarely focused on making sure we continue to proactively address this issue in a way that reflects our zero-tolerance for any kind of discrimination and upholds the values of our Fraternity. We teach our members to serve as role models in their communities and to live up to our creed, “The True Gentleman.”

SAE attorney wants second chance for fraternity after viral video fallout KFOR.com

I hope they keep the fraternity off the campus. The fact that the house mother was a racist as well tends to make me believe there is a problem that is bigger than what we have seen. I found this in the article you posted so thats good news.

Standard deflection. Pretty soon the violent crime rate gambit will be deployed.

They don't have squat. Since the national SAE organization closed this chapter perhaps this attorney should advise them to sue themselves. :p

Exactly. Thats why I keep laughing at some of these posters.

Since the national SAE organization suspended the OU chapter, any suit against OU on the chapter's behalf is meaningless. The alums' argument is with their own national organization.

Anything but the topic at hand...

The school would not be liable because they did not endorse what the Frat did.

"Creating a Hostile Environment" Charges are merely an attempted end run around the 1st amendment.

But if they didn't kick them out, the public opinion would be they implicitly endorse the mentality of the fraternity.

That hurts recruiting not only for football but for their university as well. Why risk the future of your university on 2 idiots?

So you want to deny people due process and constitutional rights because of Football?

So the mob wins every time? So only speech everyone likes is protected?

Do you people even consider what you are proposing?

What's next? We expel Christians who oppose gay marriage because it creates a "hostile environment"?

If they are doing something overt like Westboro baptist church type protest constantly on campus, then yes they are creating a hostile environment.
Yes. Inside the privacy of their frat gatherings they're creating a hostile environment.

Once it hits youtube, it's no longer private.
You mean leaked?

"...fraternity to sue university..."

Actually not.

Steven Jones is 'exploring' a 'gentleman's agreement,' meaning he knows he has no case.

Otherwise, it comes as no surprise that many on the right seek to defend racism behind the facade of 'free speech,' when in fact the issue has nothing whatsoever to do with 'free speech.'

For many on the racist right, everything.

'Rappers' are perceived by many rightwing racists as being 'black thugs and criminals,' who 'deserve' to be discriminated against.

(Trying desperately to drag the thread back from the standard and tedious third grade partisan name-calling and personal attacks and back into a conversation among mature, civil adults, he asks...)

Has anyone heard more about the specifics of any suit, or is this just in the "maybe" phase?

I would imagine that the first task of the plaintiffs' lawyers would be to look at (a) if rules were broken, and (b) if the punishment fit the crime. If the answers were yes and yes, then I wonder if they would sue anyway. If the answers were yes and yes (and I'm no lawyer), they wouldn't have a legal leg to stand on, would they? Wouldn't existing rules and regulations take precedence?

Now, if the answers were not yes and yes, this could be an interesting lawsuit.

Mac, no one wants to go to school with a couple of racist shitheads. If they had a lick of sense, they'd apply for a college in another state, and try to put this thing behind them.

That's what a sensible person does.

Any lawsuit would involve repeated playings of the scene on the bus as well as testimony of any other case where the fraternity may have sung that song, where it was learned,or was involved in similar racism

I don't think they want to go there

Yeah, that was my first thought when I heard about the (possible) lawsuit. If there is a more clear-cut, blatant example of (actual) racism out there right now I haven't seen it.

At the same time, we just love to sue, and there are always lawyers who are willing to get paid to do so. So, given that, I'm wondering what the tactic might be. Seems to me they would have to look for some weakness in either rules governing behavior or in the punishment.

Dunno.

I'm sure each fraternity has a lengthy contract with the university detailing what they can and can't do as well as the authority the university has over the fraternity.
I'm sure we will never have a n*gger in SAE falls in there somewhere

It doesn't ******* matter.

I say we tattoo SAE on their foreheads, then send them on a cross country magical mystery singing bus tour so they can sing their song for everyone.

They can sing at halftime for all the college football games. Do you think the little pussies can handle that?

If I were one of those fratbrats, I believe I would be finishing my college courses somewhere in Europe.

I beleive that the individual students that were expelled have a good case if they decide to lawyer up and pursue it. However, the path of least resistance may be to simply transfer to another college.

Jamiston Winston stood on a table and shouted "I want to **** her in the *****", and he only had to sit out a football game at Florida State.

College students often do or say really stupid things because they think they are being funny. They rarely get expelled for doing so.
