Journalists don't get to commit crimes just because they're in the media.

And Don Lemon isn't working for any media company.

The 1st Amendment doesn't effect the media like it does the rest of us. Individuals can say anything they want in public.

The media has to conduct themselves in a trustworthy manner at all times or face losing the trust of the public.

Losing the trust of the public should effect their ability to broadcast on the airwaves, and their ability to get a federal license.

He wasn't arrested for being an ass - which if that was against the law, he would be serving a life sentence.
He was arrested for violating the FACE act. I would imagine they will tag on trespassing with criminal intent and facilitating a crime.
