The power and duty to apply laws belongs to the Judicial Branch. That's pretty much the core point of the distinction and separation between the two branches of government.

Second, the vote was not on the question “Did Trump commit the crime of insurrection?” And even if it was, that does not constitute an adjudication. Rather it is a political vote. Politicians vote for different reasons. I suspect that here they were voting to give a bunch of rent-a-cops a medal because … stuff.

At most, Congress could enact a law defining something that Trump is alleged to have done, as “insurrection”. But even if they did that, Trump could still not be prosecuted under that law, for anything that he is alleged to have done before that law was enacted. To try to enact a law that worked that way would make it an ex post facto law, which is explicitly prohibited under Article I, Section 9, Paragraph 3 and Article I Section 10, Paragraph 1 of the Constitution.
