As my post said, read the constitution.

The Constitution, in Article II, Section 2, says that the President “shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the Supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for.”


There is nothing that exempts temporary appointments unless the senate isn't in session.

That's it. So when the senate is in session that appointment is unconstitutional.

I'm sure they've already gotten back to work in congress. According to the constitution the AG must go through the confirmation process by the senate.

whitacker has not been approved by the senate. Rosenstein has.

Plus there's a lot of video evidence that he in no way should be our AG. He's spoken loudly how biased he is against the Mueller investigation which it's a conflict of interest for him to oversee it.

He's under investigation for fraud right now. I don't remember any AG being investigated by his own justice department since mitchell in the nixon years. That didn't end well for mitchell either. How many years did he spend in prison? He was disbarred too.

We have to wait for the ruling by the court but from what I read in the constitution, whitacker needs to be confirmed by the senate. I wouldn't be surprised if that's the ruling from the judge.
