The Bureau of Prisons shall immediately implement all instructions from the Department of Justice regarding this directive.
So convicted, and pending indictments at the time of the Pardon.
There was no pending indictment for this guy. Also the attacks were at the RNC and DNC offices, not "at or near" the capitol building.
