Contracts' "noncompete" and "poaching" clauses:

Regarding requiring employees sign noncompete agreements, refer to,

It brings to mind a company which has this "anti-poaching" clause within the contracts they offer to prospective clients. What's your opinion regarding such clauses?

“Poaching of employees:
After any incidents of XXX having directly or indirectly introduced a person to the CLIENT's or their associates', or of such XXX employees or XXX's subcontractors' workers worked in CLIENT's or CLIENT's associates sites, CLIENT and their associates will not until 90 days after the last such incidents relative to such employees or subcontractors, use such persons or subcontractors as other than XXX's employees or subcontractor; but they may do so if they obtain written permission from XXX”.
