Actually, it's the operator's responsibility to make sure the air brake system is working properly during their DOT required pre-trip inspection of the vehicle.

Right thing to do. Im not even sure he should get 10.

He made mistakes during a very high stress situation that caused an accident and killed people. People die every day from accidents.

Hopefully he is out in a couple of years.

Seems pretty reasonable to me. An accident caused ultimately by his negligence without any malicious intent.
