Canada and EU, No 1st Amendment and Thought Crimes

In both Canada and the EU the respective governments are now severely punishing citizens for expressing "hateful" ideas and thoughts.

Two questions:

Were our Founding Fathers pure genius for enshrining the right to Free Speech in the First Amendment?

Without a First Amendment, do leaders naturally degrade to an Orwellian dystopian nightmare where only political leaders enjoy any right at all

Yes and yes. When government doesn't recognize the dignity of the individual all is lost.
