As you know Jimmy Kimmel was fired from ABC.
If it’s shown that government officials coerced or pressured ABC to suspend Jimmy Kimmel (or threatened regulatory action if they didn’t), then that crosses into state action , meaning ABC’s act might not be purely private. That could make ABC’s suspension count as governmental suppression of speech, which the First Amendment forbids.
:auiqs.jpg: See little children, see the hypocrisy, see that??? Kimmell hasn't a chance of prevailing in any silly such suit, Kimmel signed a contract, and every such entertainment contract I have ever scanned, contains "the morality clause!" You're gonna have to tune in elsewhere for your daily dose of evil! :auiqs.jpg:

Cause: comedian makes inaccurate factual statements about pending criminal litigation in violation of FCC licensing terms for the airing network.

Effect:

Step 1: Nexstar and Sinclair ABC affiliates preempt the show.

Step 2: ABC pulls the show off the schedule.

Step 3: The corporate entity, Disney, who owns the network cancels the show, and, ergo the person has been effectively fired, for cause.
Er..ummm... You said he was "fired for cause", the fact is he hasn't been fired at all and neither Disney nor ABC have indicated "Jimmy Kimmel Live!" will be cancelled. My guess at this point is that the show will return in the not too distant future (along with a dramatic and insincere apology from Kimmel) and that his current contract will remain in force until expiration unless Kimmel himself finds a legal way to get out of it.

Either way Kimmel gets paid on his current contract terms, unless Disney ABC invokes some termination clause in his contract for the show which, it seems likely they would have already done if that was their intention. I suspect that Kimmel will not have his contract renewed aka same thing that happened to Stephen Colbert at CBS.

... and Kimmel is still currently on air with ABC hosting "Who wants to be a millionaire?" which ABC has already said it has no plans to change for the current season.

Maybe after all the dust settles the networks will wise up and find some actual non-partisan comedians to host Late Night format shows ala Johnny Carson and Jay Leno, after all it wasn't broke, they didn't need to "fix it" by airing hyper-partisan morons like Kimmel and Colbert.

Kimmel doesn't have a leg to stand on...no matter what the leftist loving OP or Politico would like for you to believe.
What did Kimmel say that was misleading?

And if the above is true, how did ultimately Fox prevail in their lawsuit in which they admitted they lied but that "people should have known they were lying because they're not actually a news agency but an entertainment company or something to that effect.

Referencing this:

📰 The Florida “News Distortion” Case —

  • In the late 1990s, investigative journalists Jane Akre and Steve Wilson worked for WTVT (a Fox-owned station in Tampa, Florida).
  • They were working on a story about rBGH (recombinant bovine growth hormone) in milk, and whether it posed risks to human health.
  • Allegedly, after pressure from Monsanto (rBGH's manufacturer), the station asked them to distort or soften the story.
  • Akre and Wilson refused, and were fired. They sued under Florida’s whistleblower laws, claiming they were terminated for refusing to broadcast false information.

🧑‍⚖️ The Ruling:

  • The jury found in favor of Akre, awarding her damages.
  • But on appeal, the decision was overturned. The appeals court held that the FCC's policy against news distortion is not a law, so Akre wasn’t protected under the state’s whistleblower statute.

First, Kimmel lied about the political affiliation of Charlie Kirk's assassin for political purposes:

You can say "Oh, but he was mistaken!".

Then he should have issued a correction and apologized.

Instead, he has doubled down.

Second, Fox News is a CABLE outlet, not subject to FCC rules for public broadcast license.

ABC as a broadcast license holder is under FCC jurisdiction and all the rules and regulations that entails.

Just the same way your Drivers License requires you to obey traffic rules and regulations or be subject to suspension.

And one of those rules is to not mislead the public intentionally.

First he lost Sarah Silverman to Matt Damon … now this.

Sucks to be Jimmy.

I also read that he was Republican & MAGA but if you remember, we didn't know anything about the shooter for days, other than the person shown on the roof appeared to be a white male of college age.

Once he was identified then it began coming out that he came from a [MAGA] Republican family, perhaps the assumption was that he voted Republican as well. But what we do know is that he was NOT any of the things that were alleged IMMEDIATELY after the shooting and for certain that the HBCUs had done nothing to warrant the bomb and other threats against them that began in the immediate aftermath and continued into the following week.

There is no free speech. There is no universal healthcare. There is no social housing. There is no basic economic rights. There is no limit on military spending and corporate welfare. There is no democracy. There is only oligarchy, inequality, and corruption in the United States.

Please post “economic rights “ from the constitution or bill of rights.

Somewhere along the line people have gotten this idea that freedom of speech equals free from consequences or accountability for how they use that freedom there are reports that Kimmel's ratings are even lower than Colberts ratings and I suspect that had more to with this than anything else Kimmel's comment gave ABC a reason to start to push him out and they took it.

Problem is, if they go to the Supreme Court, they will lose because it's controlled by MAGA loving bribed people.

Oh, and they just decided to fire him just as a Trump appointee threatened ABC with losing their license, but these two things are a coincidence???

He hasn’t been fired. Pay attention.

And the FCC has the right and duty to enforce the very laws and regulations which allow networks to obtain and retain their broadcast licenses. The airwaves don’t belong to the networks. They belong to us.

The fact that you don’t like this is a bonus.
