Everyone is entitled to "due process", but due process doesn't mean a trial. Due process can be as minor as a quick interview with an immigration official to determine status.

Being arrested by a government and then released is not grounds for political asylum. People like you have forgotten that it is POLITICAL ASYLUM, not economic asylum or religious asylum.
