Boise Mayor Says Pride Flag in Front of City Hall will continue to Fly--Despite Statute

Now..I'd not have expected this...here in Red Idaho. Of course, this is Boise, the least Red part of the state.
Given that the statute is unenforceable, as the state AG has conceded..I think that flag is going to fly for bit longer.


Boise Mayor Lauren McLean has issued a written response to Idaho's Attorney General Raul Labrador over two flags on display at Boise City Hall.

AG Labrador issued a public letter to Mayor McLean, urging her to comply with Idaho Statute HB 96, newly passed legislation signed by Governor Little that says government entities may only display federal, state, and local flags.

The City of Boise has continued to display two flags in front of City Hall that AG Labrador says are in violation: a pride flag and an organ donation flag.

The Mayor writes in part, "It's important to be honest with each other and the citizens we serve about the real issue. HB96 was brought by a legislator hostile to Boise and was touted, specifically, as a vehicle to force the City of Boise to take down the Pride flag that has flown at City Hall for nearly 10 years."

The Attorney General's letter admits that HB 96 lacks any sort of enforcement mechanism, something Mayor McLean points out in her response. "You concede that Hb96 contains no penalties, no methods of enforcement, and no rights of action, still you state that you are lobbying the legislature to deny state revenues and other appropriations from the City of Boise.' You praise your followers for being 'justifiably outraged,' directed them 'to make their voices heard directly to the Mayor of Boise,' and promise them you are 'reviewing every valuable civil legal option' to target the city.'"


Mayor McLean ends her response, "I'll be at City Hall doing the work I was elected to do, in service to a city that remains steadfast in our fidelity to the Constitution and to our commitment to liberty, fairness, and opportunity for everyone."

I, unlike you, are completely aware of who's been coming to our state.
Almost all of the Californians coming to Idaho in the last few years have been Republican or Libertarians.

Appears to be case here in Nevada also as the state has been trending rightward over the last few years.
 
That's because the measure is unconstitutional, violating government speech doctrine.

Government has the First Amendment right free expression and issue advocacy.
Charge, arrest and imprison her.
