Blaming the victim

A stumbling drunk person walks home, and is far to inebriated to remember their name much less be aware of traffic as they cross the street. At that moment a driver who is texting comes through the intersection the pedestrian is crossing, and is too preoccupied with their cell phone to see the person in the street. The pedestrian ends up through the windshield.

Victimhood, blame, discuss....
 
No! Because that would be blaming the victim! You have to pick a victim, and then blame the other person. So, who's the victim?

I don't see either to be a victim, though I could tell you that the accident will be the drivers fault because the driver has the duty to give pedestrians the right of way.
