It is not illegal to turn yourself in to seek asylum at our border. If the courts deny the asylum and the seeker somehow avoids deportation or never shows up for their hearing, then they are criminals. First offense is a misdemeanor, second offense it is a felony.

If someone sneaks in without going through border patrol, that is ciminal....first just a misdemeanor, but if deported and they enter again, it is a felony.

They don't arrest them, they detain them, until border agents can screen them for whether they meet the requirements laid out to Seek asylum.

If they don't they are deported immediately.

If they do meet the preliminary requirements for an asylum seeker, border agents set up with them a court hearing for an immigration judge to decide.

Where the problem arrives is our immigration courts are understaffed, under funded for the load, and it is taking almost 5 years to see a judge in a court hearing.

30% of border crossing encounters are deported immediately. The rest are asylum seekers, unaccompanied minor children, or parolees etc.

Most of the ones let in under Biden were asylum seekers awaiting a judge to hear their case....contrary to the Maga, trumpian, bulloney!
