Rule in pharmaceuticals is once a company creates a drug they get exclusive ownership of their drug for 10 years to recoup r&d costs and to make some money for themselves. After that they can continue to make the drug but other companies can make a generic version and call it something else.

That depends on how the virus mutated. And the way the vaccine works, there are numerous ways that the vaccine attacks the spike proteins. If one of the spike proteins mutates, and the vaccine does not recognize it, there are still other antibodies that will stick to the virus and stop it from working.
Also, the more often a virus reproduces and the more hosts in reproduces within, increases the chances of mutation. So having more nd more people vaccinated reduces the chances of more mutations.
