Obama was then free to make more nominations in the ten months leading up to the election that would be acceptable to republicans, he chose not to do so. When the presidency and senate are split justices have to be acceptable to BOTH parties. It's plain that Obama wanted to appoint another RBG who would rule by political belief, not law.
