This nails Trump's case. Besides, signing major documents by autopen is unconstitutional. The real question is, who was pushing through these pardons? It sure wasn't Biden doing all that strategic thinking.

In a 2024 DOJ investigation of Biden talking illegally home classified documents and storing them in his garage, the DOJ Special Counsel, Robert Hur, wrote in his final report that Biden had "Limited precision and recall"and that at trial he would likely be perceived by a jury as an "elderly man with a poor memory.”


AP via PennLive reported the Special Counsel wrote:

"“We have also considered that, at trial, Mr. Biden would likely present himself to a jury, as he did during our interview of him, as a sympathetic, well-meaning, elderly man with a poor memory,” investigators wrote."

President Trump has declared Biden's pardons of Anthony Fauci, the J6 Committee, and others "null and void" because they were done by autopen without Biden's full mental presence.

In a 2012 paper published by Syracuse University Law School, "The President and the Autopen: It Is Unconstitutional for Someone or Something to Sign a Bill Outside of the President's Presence" wrote:

"In sum, the President’s use of the autopen (or even a human being) to sign a bill outside of the President’s presence is unconstitutional.""

Pardons autopenned when POTATUS was nowhere near the District of Criminals....Certainly suspect, if not subject to being determined null and void.

I think the issue is over preemptive pardons. US Atty fav, Ed Martin is now on the committee investigating the constitutional ramifications of its use.
 
I don’t believe that there has ever been a SCOTUS opinion on the topic of a President’s use of the auto pen for his official signature.

But it may be a problem. This is particularly true where the President (like Potato was) happens to be demented.

I think it's been before SCOTUS from what I've read.......the thing is preemptive pardons....for what crime?

There were 8,000 Hospice Joe pardons, I doubt that brain dead fool could name a dozen of them.
