In Lujan v. Defenders of Wildlife (90-1424), 504 U.S. 555 (1992) , the Supreme Court created a three-part test to determine whether a party has standing to sue:

  • Injury in Fact : The plaintiff must have suffered an “injury in fact,” meaning that the injury is of a legally protected interest which is (a) concrete and particularized and (b) actual or imminent.
  • Causal Connection : There must be a causal connection between the injury and the conduct brought before the court.
  • Redressability : It must be likely, rather than speculative, that a favorable decision by the court will redress the injury.

Federal pardons are for crimes against the United States, the DOJ would have standing to sue on behalf of the United States

The more likely thing is charging one of xiden’s criminal cabal with one of their many crimes, and they can claim the defense and litigate it

The question being asked now is what actually constitutes a pardon. That can be reviewed by the SC, and probably will be.
 
Let’s recap……I have posted a link the clause in the Constitution that says a pardons is for those who commit “offenses against the United States. I have posted a link to the most recent Supreme Court ruling stating pardons cover people who are guilty of offenses against the United States.

I correctly pointed out Trump has standing to challenge Biden’s unconstitutional use of the pardon power due to the fact he took an oath to defend and uphold the Constitution.
