Appeals Court stops radical left judge tariff decision

A federal appeals court put the brakes Thursday on a lower court order that overturned most of President Trump’s sweeping tariffs.

A full 11-judge panel on the US Court of Appeals for the Federal Circuit stayed the order by the Manhattan-based Court of International Trade while a White House appeal is heard.

The Court of International Trade had ruled that Trump exceeded his authority under the International Emergency Economic Powers Act by imposing a 10% flat duty rate on dozens of countries around the world — as well as 25% tariffs on Canada and Mexico and 20% tariffs on China in response to illegal fentanyl trafficking.

Comment:
The Radical Left judges are exceeding their authority.
We have system of checks and balances.
The Democrats are a threat to "democracy".

They clearly spell out that tariffs (think Smoot Hawley) is an article I power. And constitutional powers can only be ceded narrowly, such as for national security. Which is why the president can put tariffs on steel, and aluminum, which are strategic materials.

In 2018, a U.S. District Judge in Texas ruled the entire Affordable Care Act (ACA), also known as Obamacare, unconstitutional. The judge, Reed O'Connor, determined that the individual mandate was unconstitutional, and because he believed it was not severable from other parts of the law, he struck down the entire ACA. The Fifth Circuit Court of Appeals later reversed O'Connor's decision

On January 31st, when Judge Roger Vinson declared the individual mandate of ObamaCare to be unconstitutional, he also determined that the legislation could not be severed from the rest of the legislation, nullifying the entire law

The radicals are the fascist judges who overruled the decision. Clearly there is no basis to impose tariffs except through normal channels. The people who made the original decision were appointed by both Republicans and Democrats including Trump.
